    Exclamation Linus Torvalds on Linux supposed patent issues

    "Linus Torvalds has a sharp retort to Microsoft executives' statements in a Fortune article that Linux violates 235 Microsoft patents. In an emailed response to InformationWeek's Charlie Babcock, Torvalds writes: 'It's certainly a lot more likely that Microsoft violates patents than Linux does.' He added: 'Basic operating system theory was pretty much done by the end of the 1960s. IBM probably owned thousand of really "fundamental" patents... The fundamental stuff... has long, long since lost any patent protection.'"
    Torvalds also commented on Microsoft's stated intention not to sue Linux users: "They'd have to name the patents then, and they're probably happier with the FUD than with any lawsuit."

    Novell, which signed a partnership deal with Microsoft in November last year, has moved to distance itself from the recent Microsoft patent claims.

    Microsoft claimed in an interview with Fortune magazine that Linux and other free software infringed on 235 patents the company holds.

    Novell, meanwhile, has rejected these claims. In a public statement the company said: "While providing numbers is new, the claims that violations exists are not new. In response to similar Microsoft claims back in November, we put out an open letter from our CEO, Ron Hovsepian, that states our position on this issue. That position hasn't changed.

    "From that open letter…'We disagree with the recent statements made by Microsoft on the topic of Linux and patents. Importantly, our agreement with Microsoft is in no way an acknowledgment that Linux infringes upon any Microsoft intellectual property. When we entered the patent cooperation agreement with Microsoft, Novell did not agree or admit that Linux or any other Novell offering violates Microsoft patents.'

    "As we've said from the beginning of this agreement, our focus has been on interoperability and making it easier for customers who have Linux and Windows to make those platforms work together. The patent agreement simply takes the patent issue off the table for those customers who are concerned about it."
