    Sec. 9.32. DEADLY FORCE IN DEFENSE OF PERSON. (a) A person
    is justified in using deadly force against another:
    (1) if the actor [he] would be justified in using force
    against the other under Section 9.31; and
    (2) [if a reasonable person in the actor's situation
    would not have retreated; and
    [(3)] when and to the degree the actor [he] reasonably
    believes the deadly force is immediately necessary:
    (A) to protect the actor [himself] against the
    other's use or attempted use of unlawful deadly force; or
    (B) to prevent the other's imminent commission of
    aggravated kidnapping, murder, sexual assault, aggravated sexual assault, robbery, or aggravated robbery.


    it doesn't cover BURGLARY!!

    gives Texans a stronger legal right to defend themselves with deadly force in their homes, cars and workplaces.

    the Neighbor who shot the 2 burglars is being considered for charges at this time because 1. the property (residence) the burglars were coming out of was not his and the Law only applies to defending your own property and your own person and family UNLESS you knew the people who owned the property and you are permitted to use deadly force only if you have been asked to protect the other neighbor's property, he has told the 911 dispatcher he didn't know who lived in the residence that was being burglarized and 2. the burglars were not armed (the neighbor told the dispatcher he didn't know if the burglars were armed or not) and they were not a threat to him because they were running away!!

    my opinion:

    this guy is an idiot:


    1. the property he was defending was not his and he was not asked by his neighbor to protect it during their absence
    2. the burglars were not a threat to his life and property because they were not in his property and all he had to do was lock his doors, call 911 and let the Police handle it;

    if during that time the same burglars decided to break and enter his property too, then he has the right to defend himself and protect his property with deadly force

    3. he went outside and shot those burglars without any provocation or threat to his life after he was told many times by the 911 Dispatcher NOT to go outside and NOT to shoot anyone

    yet he was eager to shoot and kill those burglars (a statement he made himself on the phone to the 911 dispatcher);

    this is a case of a new law that was just passed to give people the right to use deadly force if they feel their OWN Life and Property and the Life and Property of their loved one is threatened which

    was

    1. misinterpreted by this neighbor and 2. made him eager to use the law as an excuse for him to shoot someone!!

    He should definitely be charged with murder.
    And this is the exact reason that I'm against these ridiculous gun laws.
    They make sense, if people are intelligent and reasonable.
    Unfortunately, most people are morons. Like this guy.

    Lock him up and destroy his guns. And the guns of every one of his inbred relatives.

    On December 2nd, 2007 Quanell X and a tiny group of followers tried to stage a protest at Joe Horn’s house but they were chased away by hundreds of angry neighbors chanting “USA! USA!”

    Black Activist Quanell X and a handful of his New Black Panther Party minions arrived to speak out against Mr. Horn and the shooting in what he deemed to be White on Black crime.

    How is it White on Black crime when the Burglars that were shot were Hispanics?

    What Quanell might not have known is that several hundred Joe Horn supporters, including about a hundred bikers, were waiting for their arrival. It quickly became, as expected, pretty intense.

    Quanell and his group marched up to Joe Horn’s house and attempt to speak to the media (which is the only reason they’re there) and get denied by the huge crowd and roaring Harleys. Quanell and friends then attempt to move to another street and speak to the media but the crowd follows and chants “USA! USA!” until he and his friends retreat - quickly. The pro-Joe crowd was raucous and intimidating but mostly in control. Watching Quanell almost break out in tears over his inability to get media time was just priceless.

    which means they were not posing a threat to his life and his property and that he fired in self defense like he claimed!!

    I think he will be charged with murder!!

    I agree with JP on this one. The so-called "bad guys with guns" don't scare me nearly as much as the "stupid good guys with guns". And while I certainly don't condone burglary, taking the law into your own hands and becoming judge, jury, and executioner is not the answer.

    I wouldn't want to be within three miles of this guy. For all I know, the next time he shoots at someone, he may miss and hit me.

    this judge, jury, and executioner did society a favor:

    1. he took care of 2 criminals who would be going through the revolving door of a justice system with plea bargaining and reduced sentences and will be free to commit other crimes which may escalate in scale and violence

    2. the 2 criminals were also illegal aliens and he also saved the law abiding tax paying citizens a great deal of money because they would be deported, then they will snuck back into the U.S., caught again and deported again, all at tax payers' expense

    think how much money in Billions this country will save and can be used for better things if all criminals were executed instead of allowing to pass through our joke of a legal system that does nothing rehabilitate anyone and allows the same criminals to be put back on the streets because of our ridiculous plea bargaining system!!
