Stan Lee sues Marvel over 'Spider-Man' movie

NEW YORK -- The creative force behind Spider-Man, the Incredible Hulk and Daredevil filed a $10 million lawsuit Tuesday, charging his old comic book company is cheating him out of millions of dollars in movie profits.
Stan Lee, who crafted a menagerie of superpowered heroes with very human flaws, now claims Marvel Entertainment Inc. has tried to shut him out of the "jackpot" success of this summer's "Spider-Man" movie.
Lee's attorneys filed court papers in Manhattan federal court, claiming that Marvel signed a deal to give their client 10 percent of any profits from his characters used in films and television shows.
"Spider-Man" has been the year's biggest hit, grossing more than $400 million domestically -- but the 80-year-old Lee says he hasn't seen a penny.
"Despite reaping enormous benefits from Mr. Lee's creations, defendants have failed and refused to honor their commitments to him," the lawsuit charges.
Marvel has reported millions of dollars in earnings from the film but has told Lee the company has seen no "profits" as defined by their contract.
Lee hopes a judge will intervene and make sure he gets a percentage of profits from the Ben Affleck movie "Daredevil," scheduled for release in February.
He also seeks a share of profits from the upcoming movie "The Hulk," and the sequels to "X-Men" and "Spider-Man."
The lawsuit demands damages and a court order forcing Marvel to turn over Lee's share in any profits from movies about characters he created.
Marvel issued a statement saying Lee "continues to be well-compensated" for his contributions to the industry. It said the company is "in full compliance with, and current on all payments due under, terms of Mr. Lee's employment agreement."
"Spider-Man" stars Tobey Maguire as the teenage superhero, Willem Dafoe as the villainous Green Goblin and Kirsten Dunst as love interest Mary Jane Watson. Interesting news, thanks for the update. Can't really take a side without knowing further details. You have to give credit to Stan Lee... but perhaps one flaw with the guy as evident in his commentaries is that he talks too much about how great he was/is. I'm glad I didn't get the Collector's ed. of Spiderman just to relieve myself of his ego. (But I'm sure there are other goodies in that package... just making a point hehe)
As for the lawsuit... seems like two money-hungry entities fighting with greed. I await more news... i want to know who's 'side' i should be taking hehe.

I agree you need to know more before deciding, but it sounds like Marvel is trying to use some legal trick to not give Lee his cut. They owe EVERYTHING to Lee. He IS Marvel comics. Of course, when Daredevil or the Hulk flop, he might not be making such a fuss.

Do you really think Hulk will flop? I saw the trailer and people seemed pretty psyched about it. I will probably see it.

Legal tricks are great when they're working for you but horrible when they're used against you.
I really hope Stan Lee gets his money. 10%? And Spider-Man made 400-something million (can't remember if that's all profit or just total) but either way, 10% is a ton of cash. Don't forget DVD and VHS sales too.
The Spider-Man sequals with surely make tons of cash as well. Daredevil....if you ignore the trialer, yes

The Hulk may well flop... given what it's opening against(Charlie's Angels 2:The Booty Strikes Back), I wouldn't be surprised in the least if that's what happened. I'll go see both that weekend, but between the two, I think Charlie's Angels will do better, if only because there's already two one major superhero movie next summer, and there is no combination over-the-top action/boobies and booty movie next summer.

stan lee totally deserves more. but it's kind of sad that he's suing marvel, i mean he's pretty old now and he's got a lot of $millions already, how much can he spend when he's already so old? anyway, i think HULK will do well, maybe in the $75 million range, but that might be considered a flop.
